1. Respect for Intellectual Property

species.app respects the intellectual property rights of photographers, artists, and content creators. We are committed to responding promptly to claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and applicable international copyright laws.

2. Image Sources and Licensing

Images displayed on species.app flashcards are sourced through the following channels:

  • Creative Commons licensed images from platforms such as iNaturalist, Wikimedia Commons, and Flickr, used in accordance with their respective license terms.
  • Public domain images from government agencies and open repositories.
  • User-submitted images where the original creator has granted species.app a direct, non-exclusive license to use, modify, and display the image.

We maintain attribution records for every image used on our platform, including the license type, source, and credit information.

3. Filing a DMCA Takedown Notice

If you believe that content on species.app infringes your copyright, you may submit a DMCA takedown notice. To be effective, your notice must include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work you claim has been infringed (e.g., a link to your original image).
  3. Identification of the material on species.app that you claim is infringing, with enough detail for us to locate it (e.g., the URL of the flashcard or page where the image appears).
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

4. Our Response to Valid Notices

Upon receiving a valid DMCA takedown notice, we will:

  • Promptly remove or disable access to the allegedly infringing material.
  • Notify the user who submitted the content (if applicable) that the material has been removed.
  • Maintain records of the notice and the action taken for compliance purposes.

We aim to respond to all valid DMCA notices within 2 business days.

5. Counter-Notification

If you believe that material was removed in error, you may file a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which species.app may be found).
  5. A statement that you will accept service of process from the person who provided the original DMCA notice.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed material.

6. Repeat Infringer Policy

species.app maintains a policy of terminating the accounts of users who are repeat copyright infringers. If a user receives multiple valid DMCA takedown notices, their account may be suspended or permanently terminated at our discretion.

7. User Submissions and Indemnification

Users who submit images to species.app represent and warrant that they are the original creators and copyright holders of the submitted content. By submitting an image, users agree to indemnify and hold harmless species.app from any claims, damages, or legal fees arising from copyright infringement related to their submissions.

8. Good Faith

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability. We encourage all parties to act in good faith when submitting DMCA notices or counter-notifications.
